As a best practice, CIRMA recommends that any contract your municipality or public school enters into be reviewed by the project team and legal counsel to ensure that you do not knowingly or unknowingly sign a waiver of subrogation. Many standard form contracts that are used today contain several waivers of subrogation throughout the contract. When forwarding a contract for review by legal counsel, you should specifically request that all waiver, hold-harmless, or indemnity agreements contained in the contract be written for best interests of the municipality.
